Regulations on purchase, sales and transportation of hazardous chemicals

When purchasing, selling and transporting hazardous chemicals, the following regulations must be observed:

1. Procurement of hazardous chemicals

1. Hazardous chemicals business units are not allowed to purchase hazardous chemicals from enterprises that have not obtained the Hazardous Chemicals Business License.

2. Hazardous chemicals units are not allowed to purchase hazardous chemicals from hazardous chemicals production enterprises that have not obtained the "Production Safety License".

3. When purchasing dangerous chemicals, hazardous chemical units shall not entrust units without hazardous chemical transportation qualifications to transport dangerous chemicals; they shall not entrust units without hazardous chemical transportation qualifications to hazardous chemical sales units to transport dangerous chemicals. Chemicals inspected and put into storage.

4. Hazardous chemical units that purchase highly toxic substances must obtain a license issued by the public security department to purchase and transport highly toxic substances.

5. When hazardous chemicals units purchase hazardous chemicals, it is necessary to require hazardous chemicals production or business units to ensure the integrity and consistency of the purchased hazardous chemicals."Chemical Safety Technical Instructions" and "Chemical Safety Labels".

(2) Sales of hazardous chemicals

1. Hazardous chemicals production and business units are not allowed to sell hazardous chemicals production enterprises that have not obtained hazardous chemicals "Safety Production License".

2. Hazardous chemicals production and trading units are not allowed to sell hazardous chemicals to hazardous chemicals operating enterprises with the Hazardous Chemicals Business License to people who have not obtained hazardous chemicals.

3. Hazardous chemicals production and business units are not allowed to sell hazardous chemicals to hazardous chemicals storage (use) enterprises with the Safety Assessment Review Opinion and the Hazardous Chemicals Storage (Use) Registration Certificate to people who have not obtained hazardous chemicals.

4. If a hazardous chemical production or business unit sells hazardous chemicals, it shall not entrust a unit without the qualification for transporting hazardous chemicals to transport hazardous chemicals; nor shall it entrust a hazardous chemical procurement unit without the qualification for transporting hazardous chemicals to inspect and deliver goods.

5. Units producing and operating highly toxic chemicals are not allowed to purchase or transport permits from individuals or units without purchase certificates.

6. Hazardous chemical production units must establish a registration system and files for hazardous chemical containers and packaging materials, and are not allowed to use hazardous chemical containers and packaging materials produced by non-designated enterprises to package, contain or transport hazardous chemicals.

7. When hazardous chemicals production units sell hazardous chemicals, they should attach the Chemical Safety Technical Instructions and Chemical Safety Labels that are completely consistent with the hazardous chemicals.

(3) Transportation of hazardous chemicals

1. Hazardous chemical transportation enterprises must obtain the qualification of hazardous chemical transportation enterprises approved and issued by the transportation or maritime department.

2. Drivers, crew members, loading and unloading managers, and escorts engaged in road and waterway transportation of hazardous chemicals must pass the examination of the legal department and obtain employment qualification certificates.

3. Hazardous chemicals transportation enterprises are not allowed to transport hazardous chemicals consigned by hazardous chemical production enterprises that have not obtained the "Production Safety License", hazardous chemical trading enterprises that have not obtained the "Hazardous Chemicals Business License", and storage (use) enterprises that have not obtained the "Safety Assessment Review Opinion" and "Hazardous Chemicals Storage (Registration) Certificate". When transporting highly toxic drugs, the shipper's "Highly Toxic Drug Purchase License" and "Highly Toxic Drug Transportation License" should also be checked.

(4) Legal provisions related to precursor, explosive and highly toxic chemicals (excerpt)

1. Hazardous chemical production enterprises and operating enterprises that sell highly toxic chemicals and explosion-prone dangerous chemicals shall truthfully record the name, address, name, ID card number of the purchasing unit, and the highly toxic chemicals purchased., variety, quantity and use of explosion-prone dangerous chemicals. The retention period of sales records and copies of the handler's identity certificate, copies of relevant licenses or supporting documents shall not be less than one year.

2. Enterprises and purchasers of highly toxic chemicals and explosive dangerous chemicals shall, within 5 days after the sale or purchase, report the varieties, quantities and flow directions of the highly toxic chemicals and explosive dangerous chemicals sold and purchased to the public security organ of the local county-level people's government for filing and inputting it into the computer system.

3. Units that use highly toxic chemicals and explosive dangerous chemicals are not allowed to lend or transfer the highly toxic chemicals and explosive dangerous chemicals they purchase; if transfer is really necessary due to production change, production suspension, relocation, closure, etc., they shall transfer to units with relevant licenses or supporting documents, and promptly report the relevant situation to the public security organ of the local county-level people's government after transfer.
